The negligent lawsuit Waldrop v. Dermatology Associates of Atlanta arises out of negligence that led to failed diagnosis and delay of treatment.
In 2013, Dr. Joseph Payne removed a cancerous lesion from Tony Waldrop’s right ear that pathology confirmed contained peri-neural invasion, an aggressive indicator requiring immediate referral to oncology. No referral ever occurred. Months later, when Tony returned with a painful lesion in the same area, Dr. Payne misdiagnosed it as benign, removed it, and threw the tissue away without sending it for pathology. That delay allowed the cancer to advance into the parotid gland, ear canal, facial nerve, and surrounding structures.
